The U.S. Department of Labor was expected to issue revised rules under the Federal Family and Medical Leave Act (FMLA) . However, in lieu of doing so, the DOL recently published a request for information on FMLA in the Federal Register. The notice may be reviewed at http://www.dol.gov/federalregister/Search/GetHtml.aspx?DocID=12428.
The notice provides a (60) day comment period ending on February 2, 2007. Employers covered by the federal FMLA are strongly encouraged to review the notice and consider commenting on your experience in administering the Federal FMLA. This notice is a request for information and not a Notice of Proposed Rulemaking. We are hopeful that a full rulemaking will occur in the near future.
The National Coalition to Protect Family Leave (NCPFL) - http://www.protectfamilyleave.org/ - recently held its first meeting and plans to meet again to discuss this notice. NAM's Director of Human Resources Policy will be distributing meeting notices to Coalition members as meetings are scheduled. Wisconsin Manufacturers and Commerce is a member of the NCPFL and will likely file comments with the U.S. Department of Labor.
Please feel free to contact your Ruder Ware attorney or Attorney Jeffrey T. Jones, who prepared this notice, if you have any questions. Thank you.
